Our Approach
Entrusting your dispute to the court process can be risky, costly and highly time consuming. Exploring settlement through negotiation or mediation is now expected by courts and judges. Most litigants do not enjoy their day in court and may not be satisfied with the outcome, or the hefty financial loss sustained in undertaking a legal battle. We also know that an agreement created by those in dispute has a far higher chance of working to their benefit, than any court order. This is because through good negotiation or mediation through a neutral, you will be able to create an agreement that protects everyone’s interests…known as the win/win.
When a professional or important relationship has broken down and communication is tainted with anxiety and distrust, it can be daunting to take those steps towards resolution. The mediation we practice at Atlas is an informal process, aimed at facilitating your negotiations with an impartial, neutral mediator in a safe confidential space. Through careful questioning and enquiry we work to guide your mediation, listen with empathy, identify your key interests and be a reality check sounding board. We don’t disempower you by giving an opinion, or suggesting a solution. Atlas Mediation is focused on guiding you and other participants towards an agreement that works for each of you.
Civil
Mediation works best before a claim is lodged in court, but it remains an available option at any point before trial. The earlier a Mediator is involved, the more time loss and anxiety is avoided. Atlas can assist in any civil case from issues between landlord and tenant, claims for damages or personal injury.
Commercial
Commercial disputes can ruin business relationships, damaging reputations and profitability. Mediation offers a chance for parties to meet face to face or communicate through a neutral. It may be possible to create understanding, identify common interests, and salvage a relationship or find a mutually agreeable way to move on. If Mediation produces a settlement agreement, it will be a legally binding and bring the dispute to a close.
